1. Acceptance of Terms

By accessing and using whyhireclay.ai ("the Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

The Site is operated by Clay Cash ("we," "us," or "our"). Contact: info@cdiscovery.io.

2. Description of Service

The Site provides:

  • ClayBot — An AI-powered chatbot that provides information about Clay Cash's professional background, expertise, and services. ClayBot is powered by Anthropic's Claude API.
  • Informational content — Professional portfolio and services information.

3. AI Chatbot Disclaimer — Informational Only

ClayBot is an AI assistant that serves as the virtual representation of Clay Cash and his 30 years of experience. While it is trained on Clay's actual words and expertise, all information provided is purely informational and for general guidance only.

  • ClayBot responses are AI-generated and may not perfectly represent Clay Cash's views in every instance.
  • There is no guarantee of accuracy. ClayBot may produce inaccurate, incomplete, or outdated information. Always verify important details independently.
  • Information provided does not constitute legal advice, professional consultation, technical recommendations, or a binding offer of services.
  • For eDiscovery, legal technology, data analysis, and Relativity platform questions, ClayBot draws on industry knowledge and Clay's expertise, but responses should not be treated as legal counsel or certified technical guidance.
  • All information should be validated by qualified professionals before being relied upon for business, legal, or technical decisions.
  • Clay Cash assumes no liability for actions taken based on ClayBot's responses.

4. Acceptable Use

You agree not to:

  • Use the chatbot to attempt to extract, manipulate, or exploit the underlying AI system.
  • Submit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Attempt to overwhelm the service through automated requests, scraping, or denial-of-service attacks.
  • Use the Site for any purpose that violates applicable local, state, national, or international law.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Submit personally identifiable information belonging to third parties without their consent.

The Site enforces rate limiting (10 requests per minute) to ensure fair access for all visitors.

5. Question Capture

The Site evaluates chat questions for substance and interest. Substantive questions — those that are idea-based, thought-provoking, or business-relevant — may be stored anonymously for the purpose of understanding visitor interests and improving services.

Simple conversational messages (greetings, acknowledgments, small talk) are not stored.

Stored questions are associated with hashed (anonymized) session identifiers, not personal information. Additional metadata stored includes conversation length, a truncated browser user-agent string, and an engagement flag for sessions with 5+ messages. For full details, see our Privacy Policy.

6. Notification Opt-In

If ClayBot cannot confidently answer a question, it may offer to notify you when a better answer becomes available. If you choose to provide your email address:

  • Your email will be used solely to follow up on the specific question you asked.
  • Your email will never be sold, shared, rented, or traded with any third party.
  • Your email will never be added to a mailing list or used for marketing.
  • Notification data is automatically deleted after 90 days.
  • You may request immediate deletion by contacting info@cdiscovery.io.

Providing your email is entirely voluntary. ClayBot will never push for contact information unprompted.

7. Intellectual Property

The Site's design, code, content, and ClayBot's knowledge base are the property of Clay Cash. You may not reproduce, distribute, or create derivative works from the Site's content without express written permission.

Your chat messages remain yours. By submitting questions to ClayBot, you grant us a non-exclusive, royalty-free license to store and analyze anonymized versions of substantive questions as described in Section 5 and our Privacy Policy.

8. Third-Party Services

The Site relies on the following third-party services:

  • Anthropic (Claude API) — Powers ClayBot's AI responses. Subject to Anthropic's policies.
  • Vercel — Hosting and serverless infrastructure. Subject to Vercel's terms.
  • Upstash — Database services (Redis for question storage and session tracking; Vector for documentation search). Subject to Upstash's terms.
  • Google Fonts — Font delivery via CDN.

We are not responsible for the practices, policies, or availability of these third-party services.

9. Disclaimer of Warranties

THE SITE AND CLAYBOT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, timely, secure, or error-free.
  • ClayBot responses will be accurate, complete, or current.
  • Any information obtained through the Site will meet your expectations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLAY CASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Site or ClayBot.
  • Any conduct or content of any third party on the Site.
  • Unauthorized access, use, or alteration of your transmissions or content.
  • Any information, advice, or recommendations provided by ClayBot.

11. Indemnification

You agree to indemnify and hold harmless Clay Cash from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Site or violation of these Terms.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
